Apple found guilty of a per-se violation of the Sherman act, for price-fixing and collusion with 5 of the 6 major publishers.

That's gonna leave a mark. And the five publishers can't be happy now either.

Oh yes indeed. They saw there was no frickin' way they could weasel out of that one, and wisely decided to take private lumps rather than vastly more painful public ones. Apple apparently thought their immense cash fund and shininess could distract the Judge from the facts of the case.
